HELD. - Admission of Jaimezs insults was within the courts discretion under Utah R. Evid. 403. The court also acted within its discretion in refusing to sever trial of multiple defendants, since Jaimez did not show that severance would have made a more favorable result likely. The "squad room" was part of the jail, and damaging the squad room therefore violated UCA 76-8-418. The trial court did not err in refusing to instruct the jury on criminal mischief as a lesser included offense. Absent a showing that tape recordings did not suffice, a free transcript did not have to be provided to Jaimez.
